Pre-release. Digital ID Checker is in development and testing. The ID check is a simulation and the service is not live for shops yet. This policy describes the current design and will be finalised, with a data protection impact assessment, before any shop pilot.
About these terms
These terms are an agreement between you and XFour IT Limited, trading as XFour Labs ("we", "us"), company number 11776254, registered office 100 Berkshire Place, C/O KT Wells Ltd, Winnersh Triangle, Wokingham, RG41 5RD, United Kingdom. By downloading or using Digital ID Checker you accept them. If you do not agree, please do not use the app.
If you got the app from Apple's App Store, Apple's Standard Licensed Application End User Licence Agreement also applies. If you got it from Google Play, Google Play's terms also apply. If those terms and these terms conflict, these terms apply, as far as the store rules allow.
How we use your personal data is explained in the Digital ID Checker privacy policy.
The app
Digital ID Checker helps licensed shops in England and Wales that sell alcohol. Staff check a customer's digital proof of age, log refusals in a Challenge 25 register, record staff training and prepare evidence for test purchases.
Using the app
- Digital ID Checker is for licensed premises in England and Wales. The shop is responsible for its own compliance with the Licensing Act 2003, its licence conditions and its Challenge 25 policy.
- Only staff the shop has authorised may sign in. Keep PINs and passwords private.
- Do not try to break, overload, reverse-engineer or get unauthorised access to the app or the services behind it.
- Do not use the app to break the law or to harm anyone.
Your content and other users
- Do not enter customer names, dates of birth or ID numbers in notes.
You keep ownership of what you create. You give us permission to store and show it, only as needed to run the app for you and the people you share it with.
Purchases
- One subscription per shop, bought by the manager in the App Store or Google Play.
Purchases are made through the App Store or Google Play and are handled under their payment and refund rules. To ask for a refund, use reportaproblem.apple.com or Google Play's refund page. Subscriptions renew automatically until you cancel them in your store account settings, at least 24 hours before the renewal date.
Our rights in the app
The app, its design, text, graphics and code belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, for your shop's business, under these terms.
Important notes
- The app helps you keep records. It does not give legal advice and does not guarantee that a check, a register or a test purchase will satisfy a licensing authority.
- If the app or the ID provider is unavailable, staff must still follow the shop's normal age-check process.
- The current version uses a simulated ID check for testing only. Do not use it to decide real sales.
Changes and availability
We keep improving the app, so features may change. We may update these terms. If a change matters, we will tell you in the app or on this page before it takes effect. We try to keep the app working, but we cannot promise it will always be available or free of errors.
Our responsibility to you
We are responsible for loss you suffer that is a foreseeable result of our breach of these terms or our negligence. We are not responsible for loss of profit, loss of business or indirect loss, or for fines or licensing action that result from how the shop runs its premises. Our total liability in any 12 months is limited to the subscription fees the shop paid us in that period. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
Ending
You can stop using the app at any time by deleting it. We may suspend or end your access if you seriously or repeatedly break these terms. If we stop offering the app, we will give reasonable notice where we can.
Law and disputes
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. Please contact us first. Most problems can be fixed quickly.
