About these terms
These terms are an agreement between you and XFour IT Limited, trading as XFour Labs ("we", "us"), company number 11776254, registered office 100 Berkshire Place, C/O KT Wells Ltd, Winnersh Triangle, Wokingham, RG41 5RD, United Kingdom. By downloading or using BoomSched you accept them. If you do not agree, please do not use the app.
If you got the app from Apple's App Store, Apple's Standard Licensed Application End User Licence Agreement also applies. If you got it from Google Play, Google Play's terms also apply. If those terms and these terms conflict, these terms apply, as far as the store rules allow.
How we use your personal data is explained in the BoomSched privacy policy.
The app
BoomSched is an unofficial festival schedule and crew planner. You star sets, rate them, share your picks with friends by QR code, link or crew code, and build day plans. It is not made by or linked to any festival.
Using the app
- BoomSched is unofficial. It is not made, approved or supported by Boomtown, Reading, Leeds or any other festival, or by any artist.
- Set times change. Always check the official festival app and screens on site. We are not responsible if you miss a set.
- Do not try to break, overload, reverse-engineer or get unauthorised access to the app or the services behind it.
- Do not use the app to break the law or to harm anyone.
Your content and other users
- Do not use display names or crew names that are offensive, or that pretend to be someone else.
You keep ownership of what you create. You give us permission to store and show it, only as needed to run the app for you and the people you share it with.
Our rights in the app
The app, its design, text, graphics and code belong to us or our licensors. We give you a personal, non-transferable, non-exclusive licence to use the app on devices you own or control, for personal, non-commercial use, under these terms.
Important notes
- Look after each other. BoomSched shows where your crew might split up, but it is not a safety or tracking tool and does not know where anyone is.
- Festival names and artist names belong to their owners and are used only to describe the schedule.
Changes and availability
We keep improving the app, so features may change. We may update these terms. If a change matters, we will tell you in the app or on this page before it takes effect. We try to keep the app working, but we cannot promise it will always be available or free of errors.
Our responsibility to you
If we fail to meet these terms, we are responsible for loss you suffer that is a foreseeable result of our failure. We are not responsible for loss that was not foreseeable, or for business losses: the app is for personal use. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or your legal rights as a consumer, including under the Consumer Rights Act 2015 for digital content that is faulty or not as described.
Ending
You can stop using the app at any time by deleting it. We may suspend or end your access if you seriously or repeatedly break these terms. If we stop offering the app, we will give reasonable notice where we can.
Law and disputes
These terms are governed by the law of England and Wales. You can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. Please contact us first. Most problems can be fixed quickly.
